Welcome to OpenUtilityLane ("we," "our," or "us"). The following Terms & Conditions ("Terms") are applicable when you utilize our yacht charter services and visit our website at openutilitylane.site, managed by OpenUtilityLane.
You consent to these Terms by reserving a charter or by using our Service. Should you not agree with any part of the terms herein, you are prohibited from using the Service.
2. Service Overview
OpenUtilityLane offers high-end yacht rental services, including:
- Yacht charters for the day
- Evening sailing experiences
- Business retreats
- Exclusive gatherings
- Extended yacht charters
We reserve the right to alter or halt services without prior notice, and all services are subject to availability and favorable weather conditions.
3. Booking and Reservations
3.1 Booking Process
Requirements to secure a charter include:
- Minimum age requirement of 18 years
- Submission of complete and truthful personal details
- Advance deposit payment as detailed in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A charter is only considered booked once the payment has been processed and our written confirmation has been issued. We retain the discretion to refuse service to any individual.
3.3 Availability
Our charters are provided based on the availability of vessels and dependent on suitable weather conditions. We endeavor to fulfill your requested dates and timings wherever possible.
4. Payment Terms
4.1 Pricing
All charges are quoted in € and are inclusive of taxes, except where noted otherwise. Pricing is liable to adjustments without prior notice.
4.2 Payment Schedule
- Deposit: A payment amounting to 50% of the total cost of the charter is required at the time of booking
- Balance: The remaining fee must be paid 48 hours before the planned departure
- Extra charges (if any): To be cleared upon the charter's completion
4.3 Payment Methods
Payments can be made via major credit cards, direct bank transfers, and certified bank drafts. Our transaction process is secure, featuring encryption protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours prior to departure: Entire payment returned minus transaction fees
- Cancellation between 24-72 hours before departure results in a 50% refund
- No refund will be provided for cancellations made less than 24 hours before departure
5.2 Weather Cancellations
In the occurrence of unsafe weather as decided by our captain, we will propose to:
- Reschedule your charter with no additional costs to another available slot
- Grant a complete refund if it's not possible to reschedule
5.3 Mechanical Issues
If mechanical issues arise with the assigned yacht, we will make an effort to arrange a fitting replacement. If this is not feasible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all instructions given by the crew
- Wear any provided safety gear as needed
- Inform us of any medical condition that can affect personal safety
- Stay within designated areas on board the vessel
6.2 Prohibited Items
Items not allowed on board include:
- Containers made of glass
- Illicit substances
- Weapons or firearms
- Excessive quantities of beverages (beyond reasonable consumption)
- Pets, unless they have been granted approval beforehand
6.3 Conduct
All passengers are expected to behave in a courteous manner. Any charter can be halted prematurely without a refund if passenger conduct becomes a safety concern or disturbs the charter's peaceful progression.
7. Liability and Insurance
7.1 Our Liability
We are only liable up to the charter cost paid. Our responsibilities do not encompass:
- Injuries to oneself due to personal negligence
- Loss or damage to personal belongings
- Indirect or subsequent damages, as well as punitive repercussions
- Delays as a result of weather or events outside our company's control
7.2 Insurance Coverage
Our organization upholds comprehensive marine insurance policies, which encompass our yachts and operational activities. Passengers should ensure they have their personal travel and belongings insurance.
7.3 Assumption of Risk
By participating in a yacht charter, you concede that water activities carry inherent risks and you are willing to assume personal responsibility for your safety and health.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, paths, or schedules due to considerations of weather, safety, or operational necessities. We will strive to provide comparable alternatives wherever feasible.
9. Force Majeure
We are exempt from liability in the case of delays, cancellations, or alterations attributed to factors beyond human control, including but not confined to:
- Extreme weather conditions
- Natural disasters
- Regulatory enactments
- Shutdowns of seaports
- Mechanical failures
10. Privacy and Data Protection
We deal with your personal data in alignment with our Privacy Policy. You are consenting to the acquisition and utilization of your data as specified in the Privacy Policy by utilizing our offerings.
11. Intellectual Property
All elements of our site, which includes text, graphics, logos, and images, are under copyright and trademark protections. Unauthorized reproduction, distribution, or derivative creation is strictly prohibited without our express permission.
12. Governing Law
The mentioned Terms are subject to the laws in force within Italy. All disputes will be resolved in the courts situated in Viareggio, Italy.
